These Terms of Service ("Terms") constitute a legally binding agreement between you and inkbookd, Inc. ("inkbookd," "we," "us," or "our") governing your access to and use of the inkbookd mobile application and website (collectively, the "Service").
By creating an account, downloading the app, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
inkbookd is a platform that connects tattoo clients with tattoo artists and studios. The Service allows clients to discover artists, view portfolios, request and manage appointments, communicate with artists, and make payments. It allows artists and studios to manage booking requests, set availability, collect deposits, communicate with clients, and showcase their work.
inkbookd is a technology platform only. We do not provide tattoo services, employ tattoo artists, or control the quality, safety, legality, or any other aspect of the tattoo services provided by artists or studios through the platform.
You must be at least 18 years of age to create an account and use the Service. By using inkbookd, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.
Artists and studios represent that they hold all required licenses, permits, and certifications to perform tattoo services in their jurisdiction and that they will comply with all applicable laws and regulations.
To use the Service you must register for an account. You agree to provide accurate, complete, and current information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must notify us immediately at contact@inkbookdapp.com if you suspect unauthorised access to your account. inkbookd is not liable for any loss or damage arising from your failure to protect your credentials.
You may not create more than one account per person or entity, or create an account on behalf of someone else without their authorisation.
When you submit a booking request through inkbookd, you are requesting an appointment with the artist or studio of your choice. A booking is not confirmed until the artist or studio accepts your request and — where applicable — your deposit payment is received.
You agree to provide accurate information when submitting a booking request, including your intended design, placement, and any relevant health or skin conditions that may affect the tattoo process. Providing false or misleading information may result in cancellation of your booking without a refund of the deposit.
You are responsible for attending your confirmed appointment on time. Failure to attend or late cancellation may result in forfeiture of your deposit in accordance with the artist's cancellation policy.
Artists and studios receive a 60-day free trial with full access to all features from the date of account creation. No credit card is required to begin the trial. After the trial period, continued use of the Service requires a paid subscription. Subscription pricing and terms will be presented to you at the end of your trial period.
Artists and studios agree to maintain accurate and up-to-date profiles, including portfolio images, availability, pricing, and studio information. Misrepresentation of your work, location, or qualifications is grounds for immediate account suspension.
Artists and studios are solely responsible for the quality, safety, and legality of all tattoo services they provide. inkbookd does not supervise or guarantee the services performed.
Artists and studios have sole discretion to accept or decline any booking request. You agree to respond to booking requests in a timely manner and to communicate clearly with clients through the in-app messaging system.
Artists and studios set their own deposit amounts and cancellation policies. These must be clearly communicated to clients at the time of booking. inkbookd is not responsible for disputes arising from unclear or undisclosed deposit policies.
inkbookd facilitates payment processing through a third-party payment processor. By using the payment features of the Service, you agree to the terms of that payment processor in addition to these Terms.
Deposits are collected from clients at the time a booking is confirmed and are held in accordance with the artist's stated deposit policy. inkbookd charges a service fee on transactions processed through the platform; current fee rates are available in your account settings.
All prices displayed on the Service are in US dollars unless otherwise stated. inkbookd is not responsible for any currency conversion fees charged by your bank or card issuer.
Cancellation policies are set by individual artists and studios and will be displayed to clients before a booking is confirmed. inkbookd does not set or control cancellation or refund policies for individual artists or studios.
In the event of a dispute between a client and an artist or studio regarding a refund, inkbookd may, at its sole discretion, assist in mediating the dispute but is not obligated to do so and is not responsible for the outcome.
Subscription fees paid by artists and studios are non-refundable except as required by applicable law.

The inkbookd name, logo, and all content and software included in or made available through the Service are the property of inkbookd, Inc. or its licensors and are protected by applicable intellectual property laws.
By uploading content to the Service (such as portfolio images or reference photos), you grant inkbookd a non-exclusive, worldwide, royalty-free licence to use, display, and reproduce that content solely for the purpose of operating and promoting the Service. You represent that you own or have the rights to any content you upload.
You retain ownership of content you upload. You may remove your content from the Service at any time by deleting it from your account.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
inkbookd does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. inkbookd does not endorse, guarantee, or assume responsibility for any artist, studio, or tattoo service listed on the platform.
To the fullest extent permitted by applicable law, inkbookd, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of the Service.
In no event shall inkbookd's total liability to you for all claims arising out of or relating to the Service exceed the greater of (a) the total amount you paid inkbookd in the 12 months preceding the claim, or (b) $100 USD.
You agree to indemnify, defend, and hold harmless inkbookd, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court if they qualify.
You and inkbookd each waive the right to a jury trial and to participate in class action lawsuits or class-wide arbitration.
These Terms shall be governed by the laws of the State of Arizona, without regard to its conflict-of-law provisions.
inkbookd may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
You may terminate your account at any time by contacting us at contact@inkbookdapp.com. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the app at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
